Terms of Service
Date Night: Deep Talk Cards — last updated October 13, 2026
In short: These terms are the license for using the app. There is no account to sign up for, nothing you post to us, and nothing we can read on your device. What you buy is a permanent unlock of the paid decks, sold through Apple. If you disagree with these terms, don't use the app.
1. Agreement
These Terms of Service ("Terms") form an agreement between you and Martin Wojtaszek ("we", "us") about the mobile application Date Night: Deep Talk Cards (the "App"). By downloading or using the App, you accept these Terms. If you do not accept them, do not use the App.
They also serve as the end user license agreement for the App. Where these Terms are silent, Apple's Licensed Application End User License Agreement applies.
2. License
We grant you a personal, non-transferable, non-exclusive license to use the App on any Apple device that you own or control, as permitted by the App Store Terms of Service. The license is for your private, non-commercial use.
You may not copy, modify, reverse-engineer, decompile, rent, lease, lend, sell, or redistribute the App or any part of it, except where that right cannot be excluded by law.
The license does not transfer ownership. The App, its question content, its wording, its artwork and its name remain ours or our licensors'.
3. Purchases
The App is free to download and includes one deck at no cost. The remaining decks are unlocked by a one-time in-app purchase — not a subscription. There is no recurring charge and nothing to cancel.
Purchases are processed by Apple, not by us. We receive no payment details. Prices, taxes, currency, and the payment method are governed by your App Store account and the App Store Terms of Service.
A purchase is tied to your Apple Account and can be restored on your devices using "Restore Purchases" in the App. If a restore fails, write to us and we will help — but we cannot grant access outside the App Store.
Refunds are handled by Apple. We cannot issue them. Requests go through Apple's support at reportaproblem.apple.com. Your statutory rights as a consumer remain unaffected.
4. Your content stays yours
Answers you write in the App are stored on your device. We do not receive them, cannot read them, and claim no rights to them. We do not back them up either — if you delete the App or lose the device, they are gone.
5. Cards you share
The App can turn a card, and an answer you write, into a link. Everything that link carries
is encoded in the part after the # and is never sent to our servers. Two
consequences follow, and both are yours to weigh:
- Anyone who has the link can read its contents. It is not encrypted, and we cannot revoke it, expire it or take it back once sent.
- How private it stays depends on how you send it. iMessage, WhatsApp, and Signal are end-to-end encrypted; SMS and email are not.
You are responsible for what you share and with whom. Do not use the sharing feature to harass anyone or to send anything unlawful.
6. Acceptable use
Use the App as it is meant to be used. In particular, do not:
- use it in a way that breaks applicable law,
- attempt to gain access to paid content without paying for it,
- interfere with the App's operation or with the servers that host its website,
- reproduce or republish the question content as your own product.
7. The questions are not advice
The App asks conversation questions for couples. It is entertainment, not therapy, counseling, or medical, psychological, or legal advice, and it is not a substitute for professional help. Answering a question is always voluntary — for you and for the person you are asking. If a conversation raises something that needs professional support, please seek it.
8. Availability, maintenance and support
We aim to keep the App working, but we do not promise it will be available or error-free at all times. Content and features may change, and decks may be added, corrected, or retired.
We alone are responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services. Reach us at sb.deeptalkcards@alive21.com.
9. Warranty and liability
To the extent permitted by law, the App is provided "as is". We do not warrant that it is free of defects or fit for a particular purpose. Nothing here limits liability for intent, gross negligence, injury to life, body, or health, or under mandatory product liability law, and nothing limits your statutory warranty rights as a consumer.
In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
Product claims. We, not Apple, are responsible for addressing any claims relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
Intellectual property claims. In the event of a third-party claim that the App or your use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
10. Legal compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-party terms
You must comply with applicable third-party terms of agreement when using the App — for example the terms of your wireless data service plan.
12. Apple as third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of them, Apple has the right — and is deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.
13. Termination
You may end this agreement at any time by deleting the App. We may end it if you materially breach these Terms. A one-time purchase you have already made is not revoked by deletion; it stays with your Apple Account and can be restored.
14. Changes to these Terms
We may change these Terms when the App changes or the law requires it. The version published here, with the date given above, is the one that applies. Continued use after a change means you accept it.
15. Governing law
German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the European Union, this choice does not deprive you of the protection of mandatory provisions of the law of your country of residence.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
